Sharing defame or religious content in India - Legal or illegal?

Is sharing content against some ministers in India is illegal in Facebook or Twitter?

It is common question one gets when he feels like forwarding some content in Facebook or Twitter, which seems to show the support of CM,PM or minister or some celebrity of country in some illegal activity. 
It may be , 

  • WIll I get arrested?
  • Do they catch only creator of the content
  • Do they catch one who has forwarded it too?
  • If yes , already 1000 people has shared the content, do they arrest all?
  • Where is freedom of speech if i cannot share.
  • We have proof. Still cannot share?
  • I do not know whether it is objectionable.
  • Can't i share any objectionable content on any body in India?

What is objectionable content or defamation here?
"The act of harming the reputation of another by making a false statement to a third person"
If some comment you are sharing/forwarding in your facebook is false or non provable or destroys peace of nation then it is objectionable.

Consider you have shared a content against your CM or MLA or MP who seem to be supporting a crime or might be trying to cover up a crime done by one of his party worker. Whole country would be aware of this . Media starts speaking on that for 24 hours of day. Best part is you just forwarded the content against celebrity in whatsapp or Facebook and you have not created it. Is it wrong to share the content now?

The answer is Yes. It is wrong, if you are sharing some content on any person in country may it be celebrity or common man when the crime done by any person is under bracket of unproved. Now lets answer the questions we listed at top.


  • WIll I get arrested?
You may get arrested if defamation case is charged against you and if you are unable to prove it.
  • Do they catch only creator of the content
They definitely catch the creator. But they may catch the one who has shared the content too. Its there in history of Indian law.
  • Do they catch one who has forwarded it too?
Earlier they did in Mumbai. In March 2015 there has been a update that section 66A has been removed which might ease out the persons sharing right again with respect to people not to mess up with religion.
  • If yes , already 1000 people has shared the content, do they arrest all?
We have history where whole village is arrested. This is not a great thing.
  • Where is freedom of speech if i cannot share.
You definitely have. Only if you are able to prove. 
  • We have proof. Still cannot share?
Definitely you can share,even if it is a content against any body. Your friends can forward it too. You may be attacked with defamation law. but at the end you will win. you may get some money as fine from the celebrity too.
  • I do not know whether it is objectionable.
Then just do not share it. 
  • Can't i share any objectionable content on any body in India?
You can share only if you have proof or if any court of India has convicted him as criminal.


  • Some media channel share this objectionable content still cant I?
Two things, See the shares of any media channels. They end these shares with question marks by India wants to know? What do you say MLA? The question marks does save them.You can follow the same.
You can forward the media content most of the time as the chances of defame action would be less and media handles it most of the time in court in right way leading the victory to its own pocket.

Religious content.
You do not have any right to share some content which hurts any other religion or which destroys peace or unity of India.  You will be penalized. May it be the attack on church or temple. May it be some photo of god which hurts some religious belief.
